A J-1 exchange visitor who is ineligible for change of status to F-1 category:
1) A J-1 exchange visitor whose status is for the purpose of receiving graduate medical education or training, and who has not received the appropriate waiver;
2) A J-1 exchange visitor who is subject to the foreign residence requirement, and who has not received a waiver of that requirement.
3. Dependents of an E, Treaty Trader or Investor, or Australian Specialty Occupation Worker

You may not be granted change of status to F-1 Category if you were admitted under the Visa Waiver Program or if your current status is:
1. A fiance'(e) or dependent of a fiance'(e) (K)(1) or (K)(2);
2. A spouse (K-3) of a
3. M-1 student;
4. An alien in transit (C) or in transit without a visa (TWOV);
5. A crewman (D)
1. The change of status request should be filed at least 45 days before your stay expires, or as soon as you determine your need to change status.
2. If the alien’s lawful status has already expired, a letter should be submitted explaining the circumstances that led to the filing of the late application. Such late applications may be approved if extraordinary circumstances are shown, the alien has not otherwise violated his or her nonimmigrant status, the alien remains a bona fide nonimmigrant, and he or she is not in removal proceedings.
